Verification of Residence Permit: A Mandatory Obligation for Employers
In accordance with Decree No. 2007-801 of 11 May 2007, specifically Articles R.341-6 and R.341-4-3 of the French Code on the Entry and Residence of Foreigners, any employer wishing to hire a foreign national must verify the authenticity of the presented residence permit no later than two working days before the employment start date.
Purpose of Verification of Residence Permit
This procedure ensures that the presented residence permit is:
- Valid (not expired)
- Authentic (not falsified or fraudulent)
Employer’s Responsibility
The employer must initiate this verification at least 48 hours before the employment contract takes effect.
If the Prefecture does not respond within two working days, the employer is considered to have fulfilled their obligation.

Once the authenticity and validity of the residence permit are confirmed, the employer may proceed with hiring the employee and completing the usual onboarding formalities (DPAE, employment contract, etc.). The request submitted by the employer, along with the Prefecture’s acknowledgment of receipt, can serve as proof in the event of an inspection.
