USA Immigration: B-1 Business Visa – Eligibility, Procedures, Timelines, Fees, and Permitted Activities
As a general rule, foreign nationals wishing to travel to the United States temporarily for business purposes must obtain a B-1 visa in advance.
However, certain nationalities — such as French citizens — are eligible for the Visa Waiver Program and are only required to obtain an Electronic System for Travel Authorization (ESTA) prior to departure, provided they meet all applicable conditions.
How to Obtain a US Business Visa: B-1
A business visa application must be submitted to the US Embassy or Consulate in the applicant’s country of origin or residence. The application process involves several steps:
- Completion of the online non-immigrant visa application form (DS-160)
- Upload of a compliant passport-style photograph
- Creation of an online account
- Payment of the visa application fee online: $185 (as of 20/02/2025)
- Scheduling of the visa interview
- In-person interview and fingerprinting
- Return of the passport with the visa
What Documents and Information Are Required to Obtain a B-1 Business Visa for the USA?
The documents required at the time of the interview may vary depending on the Embassy or Consulate, but generally, applicants are expected to provide a file including the following:
- A valid passport
- Proof of sufficient financial means to cover expenses during the stay
- A mission letter in English, on the sending company’s letterhead, stating the nature, purpose, and duration of the trip
- A return flight reservation to demonstrate the intention to leave the United States
What is the Fee for a US Business Visa: B-1?
The fee for a US B-1 business visa is $185, which corresponds to the consular processing fee payable online at step 3 of your application process.
Additional fees may apply for passport collection once the visa has been issued. For applications submitted to the US Embassy and Consulates in Paris, the following options and fees apply:
- Standard collection: free at the MBE Paris centre by appointment
- Premium collection: €14.90 without appointment at the MBE Paris 9 centre
- UPS delivery: €28.50 for home or business delivery in France and Monaco
What Are the Processing Times?
There are two types of processing times to consider when obtaining a US B-1 visa:
Appointment wait time at the US Embassy or Consulate
This wait time varies by country and depends on the workload and availability of immigration staff at the requested period. It is estimated on the website Travel.State.Gov but does not guarantee an appointment within that timeframe. As of 25/03/2025, in Paris, the waiting time for an appointment was approximately 150 calendar days, i.e., about 5 months.
Visa issuance time in the passport
Once the interview has taken place at the US Embassy or Consulate, processing the B-1 visa application typically takes 5 to 7 business days (excluding passport delivery time, which depends on the chosen return option).
It is therefore recommended to apply for the B-1 visa as early as possible since there are no expedited processing services available.
However, expedited appointment requests may be made for unforeseen and urgent business travel, subject to appointment availability and at the discretion of the immigration officer, who will assess the urgency and unforeseeable nature of the trip.
Permitted Activities with a B-1 Visitor Visa
Holders of a B-1 visa, as well as nationals eligible for visa waiver (with a mandatory ESTA), may undertake the following activities during their stay:
✅ Business meetings (negotiating, signing contracts for products to be manufactured outside the USA)
✅ Technical tasks: installation, repair, or maintenance of equipment sold by a non-US company to a US buyer, when specifically required and stated in the purchase contract
✅ Searching for commercial premises
✅ Attending professional, scientific, educational, or business conferences
✅ Delivering a professional presentation (without receiving local payment in the USA)
✅ Exhibiting at trade shows (without receiving payment from a US entity)
✅ Participating in a training programme that does not aim to provide employment in the USA
✅ Independent research
✅ Transit through the USA
The following activities are not permitted under a B-1 visa:
❌ Studying
❌ Employment (any activity not specified above)
❌ Paid representatives or professional services before a paying audience
❌ Permanent residence in the USA
Specific visa applications are required for these activities.
How to Renew My B-1 Visa?
There is no formal renewal service for the B-1 visa.
Once the visa’s validity period has expired, if further business trips are planned, a new visa application must be submitted.
Special Case: Investment Projects in the USA
The formalities required for an investment project in the USA vary depending on the project’s stage and the type of investment.
For the initial prospecting phase, which may involve trips to the USA, it is possible to enter the country with a B-1 visa or an ESTA to carry out the previously mentioned activities, within the 90-day limit for an ESTA and the duration authorised by the B-1 visa.
However, for the second phase of the project, which requires a sustained presence in the USA (such as company formation or opening a bank account), a work visa (E-1, E-2, or E-3 for treaty countries) will be necessary, supported by a comprehensive file including a detailed business plan. This type of visa allows the investor and their family to reside in the USA.
